It seems a majority of homeowners do not attend the foreclosure hearing when the bank is suing them to take the house. This is almost universally a mistake, however, as the banks and courts are well aware of the fact that the owners are facing financial hardship and can not make the mortgage payment. This gives the foreclosure victims more leverage in working with the court and lender for a solution to avoid taking the home through the sheriff sale.
Especially for homeowners who can not save their homes, they may wish to attend the foreclosure hearing. Of course, if they have concluded there is no way to save the home and they do not have any problem with the mortgage company taking it through foreclosure, then they can probably skip the foreclosure hearing with no adverse consequences. The foreclosure process will continue according to the state foreclosure laws and the homeowners may never have to deal with a government bureaucrat or representative from the bank. With no effort by the homeowners, there is no chance to stop foreclosure, however.
The courts will award default judgment in the foreclosure lawsuit to the bank if the homeowners do not file an answer or appear at the hearing. If the foreclosure victims do not want to save the home or argue against any of the claims being made by the lender, then there may be no real reason to file any paperwork and get involved in the court process. Foreclosure can take months to wind its way through the court system, which just gives the mortgage company more time to add interest and attorney fees to the total amount owed on the defaulted loan.
This is not to say that it is always a good plan to avoid going to the court hearing, as homeowners can get concessions from the bank and courts, as well as more opportunities to prevent the full foreclosure. The best idea for going to the hearing, even if the owners do not want to keep the house, would be to tell the court that they have been trying or would like to try to sell the property to pay off the loan but have not had any luck yet. The owners can request some extra time (up to 1-2 months) to put the process on hold and find a buyer. The judge can allow them the extra time to work out the problem before going ahead with the foreclosure auction.
Possibly, with 2 extra months to sell the home, the owners would be able to find a buyer to stat the process, at least. And if they can find a buyer to put in an offer, even at a reasonable short sale, the bank will be much more willing to hold off on the rest of the foreclosure process until the sale is complete or the deal falls through. This can even include postponing an upcoming sheriff sale, as the mortgage company would rather have the loan paid off through a regular sale, instead of having to take a loss on the loan and end up with the property back. It costs the banks less money to help their clients stop foreclosure and avoid the worst of the consequences afterwards.
Requesting the court for more time to sell the house might be the best chance for the homeowners to save some of their credit, as well. Paying off a loan, even if it was in foreclosure, will be a much more positive sign to potential lenders in the future, and will avoid the homeowners having to explain why they did not save the house. Not disputing the foreclosure is one thing, but appearing at the hearing just to request more time to avoid losing the home entirely might be worth it in the long run. Even if the homeowners can not save their property, it may make sense to use the court in self-defense and get more time to improve their financial positions.

Improving Your Life in Three Easy Steps
When you stop and analyze your life, are you happy with where you are now? Are you doing what you want to do and living the life that you want to live? The chances are that the answer here is no.
Most of us tend to just float through life. We have dreams and goals but all too often we put them to one side and we let other things get in our way of achieving what we want. However, it really doesn't have to be that way and there are three simple steps that you can take today if you want to improve your life.
Step One - Knowing What You Want
The first step to changing your life is to know what it is that you want. This may sound like a simple step, but it can actually be a lot more difficult than you would first imagine.
Many people think that they know what they want, when in fact once they come to think about it, they actually have no idea. So to determine what you want out of life you should think about the following:
• What makes you happy?
• What are your talents?
• Is there anything you have always wanted to do?
Don't think about the reasons why you haven't achieved what you want as that will only give you a negative mindset. Simply list all of the things that make you happy and which you would like to achieve. Knowing what you want out of life is the first step to achieving it.
Step Two - Creating Realistic Goals
The second step to changing your life is to analyze what you want and then set simple goals to achieve them. No matter what it is that you want out of life, it can be achieved if you break it down into small steps.
If you would like a new job and you hate what you currently do then the steps you can take to change that can easily be broken down. First you need to decide what it is you want (see step one). Then you need to see what skills you need for that job. If you do not have the necessary skills then set goals to achieve them. Perhaps you could take a part time night course at college to attain the skills that you need? These days it is easy to get back into education and get the skills needed for any job no matter what your age. Then once you have the skills you can start applying for jobs that appeal to you.
If your goal on the other hand is to travel more then figure out where you want to go first and start a savings account. If you have trouble saving money then be stricter on your budget. Cut back on entertainment each month and added food that you do not need. It is surprising how much money you can save once you put your mind to it.
Step Three - Keeping Motivated
The last stage to achieving your life goals is to keep yourself motivated. This is the main step which people have a problem with. It is all well and good knowing what you want to do and setting goals to achieve it, but sticking to those goals can be hard work. However, like the saying goes "nothing that is worth it is easy to achieve." If you want something you have to work hard to get it. So do things that keep your motivation up.
If you are trying to save for a holiday then keep brochures of where you are going so that you can keep looking at it. Make an itinery showing where you will be going and what you will be doing. This should help you to stay focused on what you want and you will then be likely to save more for the holiday.
Overall no matter what your goals, if you follow the above three steps then you can change your life for the better. It is all about keeping a positive state of mind and doing things that keep you motivated to follow through with your goals.

What Determines A Healthy Body?
If you are taking the time to read this you more than likely consider yourself a health conscious person. So, if you consciously make healthy decisions for yourself, good for you! What is CR? At the macro or community level, it deals with all the things a community is exposed to: all the different nearby sources of air pollution, water pollution, etc. Federal, and most state regulations look at individual sources but fail to look at what effects all sources have added up...a.k.a cumulative impact.
Let's take it to a personal level. Since WWII, our industrialized society has surrounded us with a myriad of chemicals. These chemicals are found in our carpets, paints, furniture, cloth dyes, soaps, detergents and household cleaning supplies. Of the thousands of chemicals within just as many products, more than 60% are not even studied. Some of the ones that are studies are known to be dangerous, even cancer causing. But, industry will tell you that the level any particular chemical within their product is safe. At the individual level, it very well may be. BUT, what if that same chemical is found in six other products you also use daily or weekly? What about its safety now. Industry cannot answer that nor does it try as the law does not say they need too. As we all probably bathe daily with soaps and shampoos and clean our houses and apartments regularly, what is the cumulative impact of all of those "safe" levels of chemicals?

Choosing Bible study materials can determine whether those who attend Sunday School experience spiritual transformation in studying God's Word or simply learn information. Matthew 6: 33 tells us "to seek first the kingdom of God and His righteousness". Sunday school should help and encourage the children to do just that by the choice of good Bible based materials.
3. Do they lead believers to develop a perspective of life that sees the world through the lens of the Scripture?
John 17: 15-16 I do not pray that You should take them out of the world, but that You should keep them from the evil one. They are not of the world, just as I am not of the world. "Remember the children are with you for a short few hours a week. The major part of their week will be spent at school or home.
4. Do they explain the 5 fold ministry of the church?
Ephesians 4: 11 "And he gave some, apostles; and some, prophets; and some, evangelists; and some, pastors and teachers;" Sunday school is about teaching the children to be part of God's family, amongst them you will have all the above.
5. Do they lift up evangelism in every study in which the emphasis appears in the Scripture text being studied?
Matthew 28: 19-20 "Go ye therefore into all the world; preach the gospel unto ev'ry one; Teach all nations to observe all things I have commanded you.
6. Do they encourage people to grow in their faith and participate in other discipleship opportunities?
Jude 1: 20 "But you, beloved, building yourselves up on your most holy faith, praying in the Holy Spirit."
7. Do they affirm the home as the centre of biblical guidance and help equip Christian parents to fulfil their responsibility as the primary Bible teachers and disciples of their children?
Exodus 20:12 "Honour your mother and your father". Sunday school is where children should learn about the role of the family unit.
8. Do they help lay foundations of the Christian faith and engage the children in a process of
instruction that compels Christians toward spiritual transformation?
1 Corinthians 15: 3-8 "For I delivered unto you first of all that which I also received, how that Christ died for our sins according to the scriptures; And that He was buried, and that He rose again the third day according to the scriptures:" The Christian faith is founded on Jesus Christ and His resurrection.

The Power to Feed the World? A Tale of Sustainable Development, BioEngineering, and Citizen Activism
Even set against the standards established by today's behemoths of international trade and commerce, The Monsanto Company is a veritable giant. Since its founding in 1901, Monsanto has advanced through various embodiments, most often as a producer and purveyor of chemicals. Its many mergers and acquisitions have often dramatically altered the scope of its operations, and as the twentieth century came to a close Monsanto began a transition of its principal role from that of a chemicals company into a formidable biotechnologies operation where she remains today. Following this transformation Monsanto has sought to portray itself as a soldier of the sustainability cause; on its homepage a brief description asserts that "We apply innovation... while also reducing agriculture's impact on our environment." Monsanto maintains 17,500 employees around the globe, and recorded revenues of US$7.344 billion in 2006. And yet all is not well in the corridors at Monsanto headquarters in Saint Louis.
Monsanto continues to carry the baggage of some dubious legacies which predate its biotechnologies reincarnation. Amongst them is the Texas City Disaster, a 1947 explosion during loading of its fertilizers at Galveston Bay which is considered the largest industrial accident in American history. In the years of the Vietnam War Monsanto supplied the defoliant Agent Orange to the United States Armed Forces for use in its herbicidal warfare program. In a 2002 report Monsanto was identified by the United States Environmental Protection Agency (EPA) as being a "potentially responsible party" to the contamination of 56 industrial sites. Its popular "Roundup" glyphosate herbicides are cited in a number of studies as causes of cancer (though a number of countervailing studies refute these claims). Monsanto has been accused or implicated in a litany of cases of adverse health effects on both employees at its plants and users of its products. And Monsanto's enthusiastic use and promotion of genetically modified seeds has provoked the ire of many in Europe and beyond, where a deep public mistrust of these organisms remains widespread.
Enter Marie-Monique Robin. The veteran French investigative journalist has never earned a reputation as a scourge of corporate interests in the spirit of such crusaders as Ralph Nader; her interests and works in the past have been mostly political in nature. She was widely recognized for a book and accompanying documentary film which exposed the role of French secret services in endearing certain unsavory techniques to their Argentine and Chilean counterparts during South America's troubled 1970s and 1980s. But with a new book and documentary film entitled Le monde selon Monsanto (The World according to Monsanto), she has executed a full frontal assault on Monsanto itself, and the corporate world may never be the same again.
I have neither read the book nor viewed the documentary, but to judge from reviews and from the author's own comments in interviews it seems that her premise is as follows. Following her extensive three-year investigation which exposes the depth of Monsanto's vices past and present, Robin feels that we must ask the question: "Can we believe [Monsanto] when they tell us that biotechnologies are going to solve the problems of hunger and environmental contamination?" (My own translation from the French) (source: Arte TV) In essence Robin questions the ethic, given the ignominy of its past, of allowing Monsanto to feed the world today.
The overwhelming evidence shows that Monsanto is indeed guilty of grave misconduct on many counts. Robin's work is a product of an age in which we now expect our corporations to behave as responsible members of society, and its form and tone give teeth to this approach. Not only are these expectations legitimate and real, but the citizenry is willing to act, and act decisively, to ensure corporate compliance. The forceful way in which Robin transmits this message is welcomed, and Monsanto (and indeed any and all corporations that have committed environmental and other transgressions) is to make reparations accordingly.
However I would make the point that it is important in this particular case to divorce the instances of Monsanto's wrongdoing from the bio-engineering industry wholesale. I am not delusional and I acknowledge that it is the profit motive and not a spontaneous and overwhelming altruism which guides firms such as Monsanto. However if the entire system is properly monitored, there are many poster illustrations of how the interests of global capitalism and the underprivileged need not be mutually exclusive. It is a fact that high-yield seeds and other varieties, readily proffered by Monsanto and others, have allowed for intensifications of agricultural cultivation. This is of particular importance in densely populated poor rural regions where the land available for agriculture would otherwise simply not be sufficient to carry the population. The consequent reductions of malnutrition have saved many lives and have improved countless others. A New York Times article dated October 2007 gives a a sense of the enormous transformative potential at hand if only a comprehensive implementation can be achieved. In this article, Celia W. Dugger shows that seed programs in Africa have fallen short not owing to deficiencies of the seeds themselves, but rather to inadequate farm economy infrastructure and local know-how. She highlights the pockets of success, and makes reference to India's "Green Revolution" of the 1960s and 1970s that enabled the feeding of hundreds of millions of people. India's success, she says, is attributable to the stronger farm-economy foundation with which it was endowed.
These truths serve as a telling example of the dangers that are inherent if we allow cases of corporate negligence and neglect to necessarily sink the entire ship. We can and must showcase specific outrages and demand redress, but it would be a mistake to paint an entire industry with the toxic brush. As with pharmaceuticals, the bio-engineering industry must be allowed and encouraged to continue its work with aid and input from philanthropic and other organizations, and under the oversight of national and international bodies of governance.

Blu-Ray's Going To Be The Next DVD in Technology
We all know, just a few days ago, Toshiba announced they will give up developing, manufacturing and marketing HD-DVD products. After all, the "next-generation format war" ends up. And we also know, Blu-ray Disc and HD-DVD are two new optical storage technologies that were the two sides fighting for the war, that who's going to be the successor of DVD. Is it really true that DVD has its days tapered off?
DVD is great. It can store movies, music, and even backup data with a DVD burner like Nero. Of course, all the stored can be also conversely ripped out with DVD ripper software like ImTOO DVD Ripper Ultimate. But, with the introduction of high-definition TV (HDTV) to the world, DVD storage capacity showed to be insufficient to this application.
DVD supports a resolution up to 720×480 pixels, while HDTV works with resolutions as high as 1920×1080 pixels. Just to give you an idea, two hours of high-definition video with data compression requires 22 GB of storage space. Keep in mind that the maximum capacity of a DVD is of 17 GB, if a DVD-18 disc is used (a dual-sided dual-layer disc).
So how to provide a higher data storage capacity for high-definition contents? Here are the two DVD successor candidates: Blu-ray Disc and HD-DVD.
In fact, a Blu-ray Disc or a HD-DVD is just a DVD disc with a higher storage capacity to store high-definition contents. The main motivation to the creation of a DVD successor was the introduction of HDTV, which requires a higher disc storage capacity, feature a regular DVD cannot provide. But how a Blu-ray Disc or a HD-DVD is able to store more data than a regular DVD disc?
Both Blu-ray and HD-DVD discs have the same physical size of DVD discs (and CDs), with a diameter of 12 cm (120 mm, around 4 ¾").
As we can see in Video Converter Software and Hardware Review Blog, technologically speaking Blu-ray and HD-DVD are very similar, the main difference between the two being the storage capacity.
A single-layer Blu-ray disc can hold up to 25 GB, while a single-layer HD-DVD disc can hold up to "only" 15 GB. A dual-layer Blu-ray disc can store up to 54 GB, while a dual-layer HD-DVD can store only up to 30 GB.
As we saw, on the storage size Blu-ray has a better advantage over HD-DVD, even though Blu-ray discs are more expensive. A single-layer Blu-ray Disc can hold up to 25 GB while the same disc using HD-DVD technology can store only 15 GB. A dual-layer Blu-ray Disc can store up to 54 GB, while the same disc using HD-DVD technology can store only up to 30 GB.
In terms of compatibility, both Blu-ray and HD-DVD players are capable of playing CDs and DVDs, but it won't be possible to read a Blu-ray disc on a HD-DVD player and vice-versa (it is technically possible to create a player that can read both formats, but it will probably cost almost twice, as it will need two separated circuits inside the unit, one for each technology, and someone are trying to...).
For now, DVD discs continue to be a good choice for the average Joe. If you are not a technology freak, why not just keep going with your Nero and ImTOO?
Asking Questions to Gain, Clarify and Check Information

Let's get right into why asking questions is so important, and starting with an obvious reason
1. Gaining Information
Mostly, gaining information is a good thing. It's not just about gaining added information, but also about filling in gaps in existing information. However, there are times when gaining new information may not be such a positive occurrence. If the stakes are really high, any added information that is negative could be devastating and completely block any chance of a resolution in, for example, a negotiation,
Continuing with the reference to negotiation, any added information needs to be put forward with agreement points along the way. This reduces the impact that the new information will have should it be negative.
Questions such as "What if?" need to be a constant part of this process.
2. Clarifying or Verifying Information
Clarifying questions are usually aimed at answering Wx5 +H, ie who, what, when, where, why, and how? If you don't ask such questions, you could be left at a disadvantage.
For example:
· Who is actually responsible for this?
· What are the options?
· When do you estimate that the job will be completed?
· Where is the stock to be stored?
· Why has this information not been distributed to everyone?
· How has this been handled in the past?
Verifying takes on a different form of questioning from the above:
· You will make sure that everyone knows the deadline, won't you?
· Everyone does know what aspect of the job they are responsible for, don't they?
· Does everyone know where the stock will be stored?
3. Checking for Understanding and Level of Interest
Simply because people are part of a project, does not meant that they are really interested in it and know what to do. You don't know until you ask, and then more questions may be needed to probe further.
For example:
· I know this is not your area of expertise, but tell me what you find interesting in being part of the project? [Make sure you don't ask a restrictive or closed-ended question]
Also check that that the person/people you are dealing with do actually know about the subject/product you are inquiring about. Ask a question that has a specialist knowledge aspect within it and have them respond to it.
For example:
You were checking out a new tax agent/accountant, you could ask:
· "I'd like to sell a house I own - either my home or an investment property. From a capital gains perspective, which one will be better for me?"
The answer to this question would be, to sell your home, as there's no capital gain on this transaction, but there is on an investment property (in Australia).
You get what I mean, don't you?

Fixing the Public School System

Our founding fathers fought hard to create this country and we are abandoning their ideals when we stop a child from praying in school. We need the Bible and God back in our public school system.
Downtown San Diego Condos Jump in Price YTD 2008
Downtown San Diego is a great place to live and buyers continue to push prices higher in 2008. Over the first two months of 2008, the average sold price per square foot has jumped 2% over the same period in 2007. If the market forces continue at that pace prices will be up 12% over 2007.
This factual data may come as a shock to anyone reading a mainstream newspaper real estate story because they talk in very broad terms. Sure San Diego has its problem neighborhoods with condos dropping dramatically in price, which can influence county wide data. But when you focus in on the constantly improving downtown market, demand continues to be strong and is pushing prices back up.
Yes you can find condos in downtown that are off their peak prices by 20%, but they are units that were bought, and probably will not be bought again, until inventory gets so tight it looks more attractive. This price increase of 2% was realized even when the volume of sales were down 22% compared to 2007. Why would prices be rising when volume is dropping. Well there is one component of buyers not reported in the MLS. That is buyers buying new construction. There are four condos in downtown now that are completed yet not sold out, buyers are often choosing these buildings, which are more expensive on average, so it appears volume is off more than it really is. If these new condos sales were added the price jump would be even higher, because these buildings are on the upper price range.
Two of downtown most desirable neighborhood locations, the Historic Gaslamp District and the Marina District, are completely built out with the exception of one remaining buildable lot in the Marina District. Basic economics tells us this will only cause prices to rise as demand continues to grow over time. One example of a driving force to push demand higher is the all the hotel rooms soon to be built in downtown. Look at any city that is building hotels and you will often find a red hot local residential real estate market. The Gaslamp District just experienced the opening of the Hard Rock Condo Hotel and soon will see four (4) new Marriott hotels build, two in the Gaslamp and two a few blocks over.
